Please read these Terms of Service ("Terms") carefully before using TheFoodQA.com ("Site"). By accessing or using the Site or our services, you agree to be bound by these Terms. If you do not agree, you may not use the Site.

1. Services

The Site provides information about food safety, quality, and regulatory compliance consulting services, as well as access to certain tools, guides, and resources. All consulting engagements are additionally governed by a separate written agreement with clients. You acknowledge that all materials and information provided through the Site are for informational and evaluation purposes only and are not intended for general commercial use.

2. Use of Website

By using this Site, you agree to:

• Use it only for lawful purposes;
• Not interfere with or disrupt its functionality;
• Comply with all applicable laws, including intellectual property laws.

3. Intellectual Property

All content, trademarks, logos, and materials on this Site are the property of The Food QA or its licensors. You may not copy, distribute, or use any materials without prior written permission from The Food QA.

4. Digital Products and Online Courses

If you purchase downloadable materials, templates, or online courses (“Digital Products”), the following terms apply:

• License. Digital Products are licensed, not sold. You are granted a limited, non-exclusive, non-transferable license to use them for your company’s internal business purposes only. You may not resell, share, or distribute these materials outside of your organization without prior written consent from The Food QA. 
• Payments. Payment must be received in full before you gain access to any Digital Product. Prices are subject to change without notice. You are responsible for any applicable taxes.
• No Refunds. Due to the nature of digital products, all sales are final and non-refundable, except where prohibited by law.
• Course Access. If you purchase an online course, access may be provided for a defined period of time, as stated at the time of purchase. We reserve the right to update, modify, or discontinue any course at our discretion. You are responsible for ensuring you have the necessary technology to access course materials.

5. Disclaimer of Warranties

To the maximum extent permitted by law, the Site and services are provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to warranties of accuracy, reliability, or fitness for a particular purpose.

6. Limitation of Liability

In no event will The Food QA be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, revenue, business opportunities, or data, even if advised of the possibility of such damages. Our total liability for any claim related to the Site or services will not exceed the greater of (a) the amount you have actually paid to us for the services giving rise to the claim, or (b) one hundred U.S. dollars ($100).

7. International Use

The Food QA is based in the United States and makes no representation that the Site, services, or Digital Products are appropriate or available for use outside the U.S. If you access the Site from Canada or any other jurisdiction, you do so at your own risk and are responsible for complying with local laws.

8. Governing Law

These Terms are governed by and construed under the laws of the State of California, without regard to conflict of law principles. Any legal action arising under these Terms will be brought exclusively in the state or federal courts located in Los Angeles, California.

9. Severability and Waiver

If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect. Failure to enforce any right or provision will not be deemed a waiver.

10. Changes to Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised “Effective Date.” Your continued use of the Site or services after such updates constitutes acceptance of the revised Terms.
